1. Acceptance of Terms

By accessing or using Foodcrew ("the Service"), you agree to be bound by these Terms of Service and our Legal Mentions. If you do not agree with any part of these terms, please do not use the Service.

2. Description of the Service

Foodcrew is a web application that helps groups plan meals, coordinate cooking duties, generate shopping lists, and track shared expenses for group trips and outdoor adventures. The Service is available through a web browser and as a Progressive Web App (PWA).

3. User Accounts

You must create an account to access most features of the Service. You are responsible for:

Providing accurate and complete registration information.
Maintaining the confidentiality of your login credentials.
All activity that occurs under your account.

You must be at least 16 years old to create an account. If you become aware of any unauthorised use of your account, notify us immediately at contact@foodcrew.net.

4. Subscriptions and Billing

Foodcrew offers a free tier and a paid subscription plan (Pro). Participants who join a trip as guests always join for free — only the trip organiser's plan applies.

Billing cycle: Paid plans are billed monthly in advance via Stripe.
Cancellation: You may cancel your subscription at any time from the billing page. Your plan remains active until the end of the current billing period; no further charges will be made.
Refunds: We do not issue refunds for partial billing periods, except where required by applicable law.
Trip packs: One-time trip-credit purchases are non-refundable once consumed.
Price changes: We will give you at least 30 days' notice before increasing prices for existing subscriptions.

5. User Content

You retain full ownership of all content you create in the Service, including trip data, meal plans, preferences, and expense records ("User Content"). By using the Service, you grant Foodcrew a limited, non-exclusive, royalty-free licence to store, process, and display your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for the accuracy of the content you submit. Do not enter sensitive personal or medical information beyond what is required to plan group meals.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation.
Infringe the intellectual property rights of third parties.
Transmit spam, malware, or any harmful content.
Attempt to gain unauthorised access to our systems or another user's account.
Reverse-engineer, decompile, or scrape the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these rules.

7. AI-Powered Features

Foodcrew offers AI-powered features including meal suggestions and ingredient list generation ("AI Features"). These features are powered by OpenAI's API and are available on the paid subscription plan (Pro). The free plan does not include AI Features.

Quota: Pro plan subscribers have unlimited AI calls. Free plan organisers can unlock AI Features by purchasing an AI Calls Pack.
No guarantee of accuracy: AI suggestions are generated automatically by a third-party AI model. They are provided for convenience only and may be inaccurate, incomplete, or unsuitable for your needs. You remain solely responsible for reviewing and validating any AI-generated content before acting on it.
Data sent to OpenAI: To generate suggestions, relevant trip data (meal types, number of participants, dietary restrictions, allergies, and food dislikes) may be transmitted to OpenAI. No names, email addresses, or financial data are sent. By using AI Features, you consent to this transmission.
Availability: AI Features depend on the availability of OpenAI's services. We do not guarantee that AI Features will be available at all times.

8. Intellectual Property

The Foodcrew name, logo, design, and all original software are the exclusive property of Foodcrew and its licensors. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding.

9. Privacy

Our collection and use of personal data is described in the Legal Mentions page, which forms part of these Terms. By using the Service, you consent to such processing.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

11. Limitation of Liability

To the maximum extent permitted by law, Foodcrew shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will endeavour to give reasonable notice of significant changes that affect paid users.

13. Changes to These Terms

We may update these Terms of Service at any time. If we make material changes, we will notify you by email or by displaying a notice in the Service. Your continued use of the Service after the effective date of updated terms constitutes your acceptance of those changes.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with French law. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts of France.
